Fearful people must not be given the power to punish unconventional people for the fear that non-conformity elicits in fearful people. Granting that power to fearful people will promote terrible patterns of conformity. Fearful people wish to prevent behavior which has unknown consequences. Unconventional behavior has unknown consequences. Fearful people seek to prevent unconventional behavior, and stand ready to punish people who through unconventional behavior threaten the possibility of future damage. Thus fearful people stand ready to punish creative people who are willing to try new life styles which might promote greater understanding--- because such life styles appear dangerous to fearful people. Fearful people feel threatened to many forms of intimacy, and fear the consequences of unregulated intimacy. Thus fearful people tend to punish people for intimate behavior which fearful people fear will occasion future damage. Punishment for future damage requires a theory of likelihood of future damage. If such a theory is dominated by fear rather than by existential evidence the punishments are likely to be inappropriate and generate perverted behavior. In a fearful context it is very difficult to make an unbiased evaluation of the consequences of actions which occasion apprehension on the part of fearful people. It is difficult to access damages when they include imagined damages, psychic damages, emotional injury, psychological discomfort, an other subjective damages. It is difficult to define the grounds for having standing in regards to subjective damages, and so grounds for legitimate protest.
