Rarely is justice viewed as relevant to emotional relationships. Even where it is within marriage, the institution of marriage is defined in terms of capitalistic categories: possession, exclusion, con- trol, ownership, rights, responsibilities, profit, cost, etc. Such justice is defined in very technical, legalistic, terms. Such, justice is mediated by technically oriented specialists: policemen, case workers, lawyers and judges. Under such circumstances, justice tends to involve a contest in which the game played is based upon capitalistic desires to win at the expense of the other. At a humane level, emotional justice involves mutual vulnerability and full reciprocity. The participants in such an emotional relationship are each equally vulnerable to what the relationship will make of them, with none of them unilaterally controlling the relationship. The participants are not unchanging elements which are interacting with each other to create the emotional relationship, as much as they are subjects of the relationship---vulnerable to the changes in them which the relationship may prompt. In such a humane relationship emotional justice is not a technical consideration, one where computations can balance the equation of fairness. Emotional justice, rather, has to do with whether there is mutual awareness and mutual understanding within a context of mutual vulnerability to a relationship which transcends the participants. Thus, justice cannot be determined by technicians who stand outside the relationship. Justice is not an objective fact, but a subjective reality. Such a justice, which is at one with Love, is what empowers the participants to grow within a society which is characterized by what technicians may rightly describe as objective justice. Such objective justice does not flow from technical definitions of right behavior. Such technical definitions may properly pass judgement to the effect that justice is absent, but they cannot succeed in creating justice when it is absent. The law cannot reduce estrangement which occasions injustice---by accurately describing the injustice or in any other way. Only a love which has integrity (bringing together agape, eros and philos) can do that. (c) 2005 by Paul A. Smith in Search for Integrity and Honesty (On Being Yourself, Whole and Healthy) ==========================================================
