In the former case there is a constitutional prohibition against enacting laws which focus upon behavior which is motivated by clearly religious considerations. Most of the people who ask intrusive questions about the private lives of other persons are motivated by clearly religious considerations---so their behavior cannot easily be forbidden. Rather the provisions guaranteeing freedom of speech, assembly and petition need to be used to expose how the people who ask intrusive questions and violate people's rights to privacy---are insecure people who are driven by fear and paranoia, rather than guided and motivated by Love. God is Love. God does not guide and motivate people to ask intrusive questions about private lives. Fear motivates and guides people to ask intrusive questions about their private lives.
